Terms of Service

Effective September 14, 2026

These Terms of Service (“Terms”) are a binding agreement between you and Summit West LLC, a Michigan limited liability company doing business as sometime. (“sometime,” “we,” “us”) governing your use of the sometime iOS app, its iMessage extension, the booking pages at thesometime.app, and related services (together, the “Service”). By installing the app, sending an invitation, or booking a time through a booking page, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

1. Who may use the Service

You must be at least 13 years old (or the age of digital consent where you live) to use the Service, and at least 18 or the age of majority in your jurisdiction to enter into these Terms yourself; otherwise a parent or guardian must agree on your behalf. By using the Service you represent that you meet these requirements and that you are not barred from using it under applicable law.

2. What the Service does

sometime lets a Sender share times they are free and lets a Recipient choose one. The Service computes open times from the Sender’s availability rules and busy/free information, holds a chosen time so it cannot be double-booked through sometime, and writes confirmed bookings to the calendars each party selects. Recipients do not need the app or an account.

The Service is a scheduling convenience, not a guarantee. sometime does not control your calendar providers, does not verify that either party will attend, and cannot prevent conflicts created outside the Service (for example an event added directly to a calendar after a time was offered). You are responsible for confirming plans with the people you schedule with.

3. Your license to use the app

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the app on Apple-branded devices you own or control, as permitted by the App Store Terms of Service. You may not copy, modify, distribute, sell, lease, reverse engineer, or attempt to extract the source code of the Service, except to the extent applicable law expressly prohibits that restriction.

4. Acceptable use

You agree not to:

5. Your content and calendar data

You retain all rights to your calendar data, display name, activity presets, and anything else you provide (“Your Content”). You grant us a worldwide, non-exclusive, royalty-free license to host, process, transmit, and display Your Content solely to operate, secure, and improve the Service and as described in the Privacy Policy. You are responsible for having the rights and permissions needed to share Your Content, including any calendars you connect, and for the accuracy of the display name and activity descriptions you send.

6. Calendar and third-party services

The Service reads and writes to calendars through Apple’s EventKit framework and, if you choose to connect one, through the Google Calendar API. Those providers remain the authority over their own events. Your use of Apple and Google services is governed by their terms, and we are not responsible for their availability, changes to their APIs, or actions they take on your account. Connecting a Google account is optional and may be disconnected at any time.

7. Recipients and booking pages

If you book a time through a booking page or message bubble you are a Recipient and these Terms apply to you. You agree to book only times you intend to keep, and you understand that the Sender will see the time you chose. A booking is confirmed only when the Service displays confirmation; if a time is taken by someone else first, the page will refresh with the times still open.

8. Cancellation and expiry

Senders may cancel an invitation at any time. Invitations expire at the end of their date window. Once cancelled or expired, an invitation can no longer be booked and its offered times are deleted. Confirmed bookings remain on the calendars they were written to; changing or cancelling a confirmed plan is between the parties.

9. Beta features and changes

We may add, change, or remove features, or suspend or discontinue the Service in whole or in part, at any time. Features labelled beta, preview, or TestFlight may be incomplete, may change without notice, and are provided with no commitment as to reliability. We will try to give reasonable notice of material changes where practical.

10. Fees

The Service is currently free. If we introduce paid features in the future we will describe the pricing, billing, and cancellation terms before you are charged, and any purchases through the App Store will also be subject to Apple’s terms.

11. Intellectual property and feedback

The Service, including its software, design, text, graphics, logos, and the sometime name, is owned by us or our licensors and is protected by intellectual property laws. Except for the license in Section 3, no rights are granted to you. If you send us feedback or suggestions, you grant us a perpetual, irrevocable, royalty-free license to use them without obligation to you.

12. Termination

You may stop using the Service at any time by deleting the app; see the Privacy Policy for how to have server-side records removed. We may suspend or terminate your access, or cancel invitations, immediately and without notice if we reasonably believe you have violated these Terms, created risk or legal exposure for us or others, or if required by law. Sections 5, 11, and 13 through 18 survive termination.

13. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, THAT OFFERED TIMES WILL ALWAYS REFLECT YOUR CALENDARS, THAT BOOKINGS WILL BE WRITTEN TO ANY CALENDAR, OR THAT ANY PERSON WILL KEEP A BOOKED TIME. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

14. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, SOMETIME AND ITS OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR MISSED APPOINTMENTS OR OPPORTUNITIES, ARISING OUT OF OR RELATED TO THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF THE AMOUNT YOU PAID US IN THE TWELVE MONTHS BEFORE THE CLAIM OR FIFTY U.S. DOLLARS (US$50). THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED BY LAW, INCLUDING LIABILITY FOR GROSS NEGLIGENCE, WILFUL MISCONDUCT, OR FRAUD.

15. Indemnification

You agree to defend, indemnify, and hold harmless sometime and its officers, directors, employees, and service providers from any claims, damages, losses, and expenses (including reasonable legal fees) arising out of your use of the Service, Your Content, or your violation of these Terms or of any law or third-party right.

16. Dispute resolution and governing law

If you have a concern, please contact us first at feedback@thesometime.app; most issues can be resolved quickly and informally. You agree to attempt to resolve any dispute informally for at least 30 days before starting formal proceedings.

These Terms and any dispute arising out of them or the Service are governed by the laws of the State of Michigan and applicable United States federal law, without regard to conflict-of-law rules, and you agree to the exclusive jurisdiction of the state and federal courts located in Michigan. To the extent permitted by law, you and sometime each waive any right to a jury trial and agree that disputes will be resolved individually and not as a plaintiff or class member in any purported class or representative proceeding. If you are a consumer in the European Union, United Kingdom, or another jurisdiction that grants you mandatory rights to bring claims in your local courts or under your local law, nothing in this section limits those rights.

17. Apple-specific terms

Because the app is distributed through the Apple App Store, the following also apply. These Terms are between you and sometime only, not Apple; Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support for the app. To the maximum extent permitted by law, Apple has no warranty obligation with respect to the app; if the app fails to conform to any applicable warranty you may notify Apple, and Apple will refund the purchase price (if any). Apple is not responsible for addressing any claims relating to the app, including product liability claims, claims that the app fails to conform to legal or regulatory requirements, or consumer-protection claims, or for the investigation, defense, settlement, or discharge of any third-party intellectual-property infringement claim. You represent that you are not located in a country subject to a U.S. government embargo or designated a “terrorist supporting” country, and that you are not on any U.S. government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You must also comply with any applicable third-party terms when using the app, such as your wireless carrier’s terms.

18. General

These Terms, together with the Privacy Policy, are the entire agreement between you and us about the Service and supersede any prior agreements. If any provision is found unenforceable, the rest remain in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Notices to you may be given in the app, by release notes, or on this website. We are not liable for delays or failures caused by events beyond our reasonable control.

19. Changes to these Terms

We may update these Terms from time to time. If changes are material we will update the effective date above and, where practical, give notice in the app. Continued use of the Service after a change takes effect means you accept the updated Terms. If you do not agree, stop using the Service and delete the app.
